The Tamil Nadu government filed an appeal against the Madras Race Club (MRC), and Justice S.M. Subramaniam of the Madras High Court has refused to recuse himself from hearing it."A judge may independently recuse himself from a case that the Chief Justice has assigned to him. He would have to decide that for himself. But recusal at the asking of a litigating party, unless justified, must never be acceded to,” the senior judge wrote when the counsel representing MRC requested him to recuse, fearing bias as the judge had passed adverse orders against MRC in another case and had also appeared against it in two cases during his stint as a lawyer.
